QBF Calculator Privacy Policy

This Privacy Policy explains how South Valley Senior Care Inc., doing business as AmeriCare Silicon Valley, the operator of QBF Calculator, also known as QBFCalc or QuickBudgetFin ("QBFCalc," "we," "us," or "our"), collects, uses, discloses, and protects personal information when you visit www.qbfcalc.com, create or use an account, use our web or mobile services, request support, subscribe to communications, or otherwise interact with us (collectively, the "Services").

This Policy applies to information that QBFCalc controls. It also explains how we handle information that business customers and their authorized users enter into the Services on behalf of their clients. If you do not agree with this Policy, do not use the Services.

1. Information We Collect

Information you provide

Account and profile information, such as your name, email address, telephone number, organization, username, password or authentication credentials, and account preferences.

Customer and client information entered into the Services, which may include names, contact details, care-related details, staffing information, schedules, notes, budget inputs, financial planning information, and other records selected by the customer.

Transaction and subscription information, such as plan, billing status, purchase history, and limited payment-related details. Payment card information may be collected directly by our payment processor rather than by QBFCalc.

Communications, including support requests, contact-form messages, survey responses, newsletter sign-ups, and other correspondence.

Any other information you choose to provide through the Services.

Information collected automatically

Device and usage information, such as IP address, browser type, device type, operating system, pages or features used, dates and times of access, referring URLs, and diagnostic or performance data.

Cookie and similar technology information used to operate the Services, remember settings, understand usage, prevent fraud, and improve performance.

Information from other sources

We may receive information from service providers, identity or authentication providers, payment processors, app stores, business partners, or a customer that invites you to or administers your access to the Services.

2. Customer Data and Our Role

Business customers decide what client and workforce information to enter into the Services and why it is processed. For that information, the business customer generally acts as the organization responsible for the information, and QBFCalc processes it to provide the Services under our agreement with that customer. If your information was submitted by a QBFCalc customer, please direct requests concerning that information to the customer first. We will assist the customer as required by law and our agreement.

Customers and authorized users must have a lawful basis and all necessary permissions to submit personal information to the Services. They must not enter information that the Services or their agreement with QBFCalc does not authorize.

3. Health and Care Information

The Services may be used to organize caregiving and client information. QBFCalc is not automatically subject to the Health Insurance Portability and Accountability Act (HIPAA) merely because care-related information is entered into the Services. A customer that is a HIPAA covered entity or business associate may use the Services for protected health information only if QBFCalc has expressly agreed in writing that the applicable Services may be used for that purpose and the parties have executed any required Business Associate Agreement before the information is submitted. Unless those requirements are satisfied, do not submit protected health information to the Services.

4. How We Use Information

Provide, operate, maintain, personalize, and improve the Services.

Create and administer accounts; authenticate users; and provide dashboards, budgeting, calculation, reporting, and customer-support functions.

Process subscriptions and transactions and communicate about accounts, security, service changes, and support.

Monitor performance, troubleshoot problems, analyze usage, and develop new features.

Protect the safety, integrity, and security of users, customers, QBFCalc, and the Services; prevent fraud, abuse, and unauthorized access; and enforce our agreements.

Comply with law, respond to lawful requests, establish or defend legal claims, and meet accounting or regulatory obligations.

Send newsletters or marketing communications where permitted by law. You may unsubscribe using the link in the message or by contacting us.

5. How We Disclose Information

We may disclose personal information in the following circumstances:

Service providers. Vendors that host data, provide cloud infrastructure, authentication, analytics, communications, customer support, payment processing, security, or other services on our behalf may process information under contractual restrictions.

Customers and authorized users. Information may be visible to the organization that provides or administers your account and to its authorized users, according to permissions selected by that organization.

Business partners and integrations. At your direction, or when you enable an integration, we may disclose information to the selected third party. That party's privacy policy governs its own handling of the information.

Legal and safety reasons. We may disclose information when we reasonably believe disclosure is necessary to comply with law or legal process, protect rights or safety, investigate fraud or security incidents, or enforce our terms.

Business transactions. Information may be disclosed in connection with financing, due diligence, a merger, acquisition, restructuring, sale of assets, or similar transaction, subject to appropriate confidentiality protections.

With consent or at your direction. We may disclose information for another purpose when you consent or direct us to do so.

QBFCalc does not sell personal information for money. We do not use or disclose personal information for cross-context behavioral advertising. If our practices change, we will update this Policy and provide any opt-out method required by law.

6. Cookies and Similar Technologies

We and our service providers may use cookies, local storage, software development kits, pixels, and similar technologies. Some are necessary for login, security, preferences, and core functionality. Others may help us measure traffic and improve the Services. You can control cookies through your browser or device settings, although disabling necessary technologies may prevent parts of the Services from working. Where required, we will request consent or provide additional controls.

7. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, maintain an account, fulfill the purposes described in this Policy, comply with legal and contractual obligations, resolve disputes, and enforce agreements. Retention periods depend on the type of information, the relationship with the customer or user, legal requirements, security needs, and whether information is needed for legitimate business records. We may retain backups for a limited period and may retain information that has been deidentified or aggregated so it no longer identifies an individual.

8. Data Security

We use administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. These measures may include encryption, access controls, authentication, monitoring, backups, and vendor oversight, as appropriate to the information and risk. No system is completely secure, and we cannot guarantee absolute security. Users are responsible for protecting their credentials and promptly notifying us of suspected unauthorized account access.

9. Your Choices and Privacy Rights

Depending on where you live and subject to applicable exceptions, you may have the right to request access to, correction of, deletion of, or a copy of personal information; to object to or restrict certain processing; or to withdraw consent. You may also update certain account information within the Services and opt out of marketing email.

To submit a request, email steve@americaresv.com with the subject line "Privacy Request." Describe your request and the account or email address involved. We may verify your identity before acting. Authorized agents may submit requests where permitted by law, but we may require proof of authority and identity. We will not unlawfully discriminate against you for exercising applicable privacy rights.

If your information is controlled by a QBFCalc business customer, contact that customer first. If we receive your request directly, we may refer it to the customer.

10. California Privacy Notice

This section applies to California residents to the extent the California Consumer Privacy Act, as amended by the California Privacy Rights Act, applies to QBFCalc and the relevant information.

In the preceding 12 months, we may have collected the categories described in Section 1, including identifiers; customer records information; commercial information; internet or other electronic network activity; professional or employment-related information; inferences derived from use of the Services; and sensitive personal information only when a customer or user chooses to provide it. We collect these categories from users, customers, devices, service providers, and business partners. We use and disclose them for the business and commercial purposes described in Sections 4 and 5.

Subject to applicable law, California residents may request to know or access personal information, correct inaccurate personal information, delete personal information, or obtain information about collection and disclosure practices. California residents may also opt out of sale or sharing and limit certain uses of sensitive personal information when those activities occur. QBFCalc does not sell personal information for money or share it for cross-context behavioral advertising, and we do not use sensitive personal information to infer characteristics about individuals. We therefore do not currently offer a "Do Not Sell or Share My Personal Information" link. If these practices change, we will provide the required notices and controls, including honoring legally required browser-based opt-out preference signals.

11. Children

The Services are intended for business users and adults and are not directed to children under 13. We do not knowingly collect personal information directly from children under 13. If you believe a child has provided personal information to us without appropriate authorization, contact us so we can investigate and take appropriate action. Customers are responsible for ensuring that any information they submit about a minor is lawful and authorized.

12. International Use

QBFCalc is operated from the United States. If you use the Services from another country, information may be transferred to, stored in, and processed in the United States or other countries where we or our service providers operate. Where required, we use appropriate safeguards for international transfers.

13. Third Party Services and Links

The Services may link to third-party websites, apps, app stores, or services. We do not control their privacy practices. Review their privacy policies before providing information to them.

14. Changes to This Policy

We may update this Policy from time to time. We will post the revised Policy on the Services and change the effective date. If required by law, we will provide additional notice or obtain consent. Your continued use of the Services after an update takes effect is subject to the revised Policy.
